Family Law services
Separation Agreements address matters such as parenting plans, support for children and spouses, life insurance, property equalization, home sale or buy-out, and various other issues. We guide you through every step of the process, including preparing your financial disclosure, crafting an offer, and negotiating the agreement.
- Marriage Contracts / Cohabitation Agreements – If you are cohabiting with someone, planning to marry or are married, we can assist you with preparing a Cohabitation Agreement or Marriage Contract. We take a sensitive and informative approach to help you achieve fairness.
- Divorce – Divorce is the legal end of a marriage. It is a formal recognition that the marriage has ended. The only pre-requisite needed for a divorce to be granted is that the marriage has completely broken down, and there is no reasonable chance that you and your spouse will get back together. We firmly advocate for our clients in Divorce and Family Law proceedings. We recognize the intricacies of the situation and take measures to initiate positive change promptly.
- Spousal Support – Spousal support is to ensure financial stability after a separation that involves financial payment made by one spouse to the other after a separation or divorce. It is intended to assist the financially disadvantaged spouse maintain a reasonable standard of living and prevent them from facing significant financial hardship. Spousal support is not an entitlement by default and hence it is crucial to consult with a family lawyer to understand your specific rights and obligations related to spousal support. We will help you navigate this complicated legal field as smoothly as possible.
- Child Custody & Access – In Ontario, child custody, currently known as decision-making responsibility, establishes which parent or parents possess the right to make major decisions regarding the child’s upbringing such as education, education and religion. Child custody agreements can be sole, in which one parent holds primary responsibility, or joint, where both parents participate in decision-making. The focus is always going to be secure the best arrangements for your children.
- Child Support – Child support is money one parent pays to the other parent to contribute to the day-to day expenses for their children following a separation or divorce. After divorce, both parents have a legal obligation to financially support their children. This obligation continues until the child is 19, or if the child is still dependent and in post-secondary education, even beyond that age. Child support is typically calculated using either the Federal Child Support Guidelines or provincial/territorial guidelines, depending on the family’s circumstances.
- Property Division – In Ontario, any property obtained during a marriage or common-law partnership must be evenly divided at divorce or separation, unless there is an alternate agreement. This encompasses properties such as houses, vehicles, enterprises, furnishings, retirement fund and cash.
